Acceptable Use Policy
This ACCEPTABLE USE POLICY (this “AUP”) identifies activities that you are prohibited from engaging in when using Hypori, Inc. (“Hypori,” “we,” “us”) software, cloud services, applications, and related services (collectively, the “Products and Services”). This AUP applies to all customers, Authorized Users, and any devices accessing Hypori Products and Services, including Hypori Mobile, Hypori Lyte for Secure Messaging, Hypori Lyte for Enterprise Browser, Hypori Lyte for Applications, and Hypori Secure Messaging.

Data Processing Addendum (DPA)
This DATA PROCESSING ADDENDUM (“DPA”) applies to the Processing of Personal Data by Hypori, Inc. on Your behalf when providing Hypori products (“Products”) and technical support services or consulting services (“Services”). The Products and Services are described in the relevant End User License Agreement, Master Subscription Agreement, or other applicable Hypori agreement, and the applicable Order for Products and Services (collectively, the “Agreement”). In the event of a conflict between the terms of this DPA and the EU Standard Contractual Clauses, the UK SCC Addendum and/or Swiss Addendum (if applicable), the terms of the EU Standard Contractual Clauses, the UK SCC Addendum and/or Swiss Addendum (if applicable) shall control. For the avoidance of doubt, this order of precedence applies solely to data protection and privacy obligations and does not override commercial terms unless required by Applicable Data Protection Laws.
Partner Data Processing Addendum (DPA)
This DATA PROCESSING ADDENDUM (“DPA”) applies to the Processing of Personal Data by Hypori, Inc. on Your behalf as a Partner or Reseller when providing Hypori products (“Products”) and technical support services or consulting services (“Services”), including where You resell, distribute, integrate, or otherwise make the Products available to End Customers.
End-User License Agreement
THIS END USER LICENSE AGREEMENT (this AGREEMENT) IS A LEGALLY BINDING AGREEMENT BETWEEN CUSTOMER AND HYPORI.
BY ACCESSING, INSTALLING, USING, OR OTHERWISE RECEIVING THE BENEFIT OF THE PRODUCTS, CUSTOMER AGREES TO BE BOUND BY THIS AGREEMENT.
IF CUSTOMER DOES NOT AGREE TO THIS AGREEMENT, CUSTOMER MUST NOT ACCESS OR USE THE PRODUCTS.

Master Subscription Agreement
This MASTER SUBSCRIPTION AGREEMENT (this “MSA” or “Agreement”) is entered into between Hypori, Inc. (“Hypori” or “Company”) and the entity identified in the applicable Order (“Customer”). This MSA governs Customer’s access to and use of Hypori’s Cloud Service Offerings and related products and services. By executing an Order referencing this MSA, or by accessing or using Hypori Products, Customer agrees to be bound by this Agreement.
Partner Code of Business Conduct
This SUPPLIER/PARTNER CODE OF BUSINESS CONDUCT (“Code”) sets out the standards, including ethical business practices and regulatory compliance, for all third-party business partners working with Hypori, Inc. (“Hypori”) (including without limitation suppliers, vendors, partners, distributors, resellers, subcontractors, agents and their employees, personnel and contractors (collectively “Supplier/Partner”). All Suppliers/Partners are expected to uphold these standards in day-to-day activities, comply with all applicable policies and procedures, and ensure that all Supplier/Partner personnel are aware of, understand and adhere to these standards.
